Terms and Conditions

1. Copyright Notice

The materials contained on the Masaru Emoto’s Hado World (“Websites”), are protected under copyright and other laws of Japan, and, under international conventions, similar laws abroad. Copyright in the materials contained on the Websites, including, but not limited to, the textual material, artwork, photographs, computer software, audio and visual elements, is owned or controlled separately (and as a collective work exclusively by Office Masaru Emoto, LLC (OME)). In addition, copyright in the selection, arrangement and coordination of materials in the Websites is owned exclusively by OME.

2. Limitations on Use by (and to) a Subscriber

The contents of the Websites may only be accessed, viewed or otherwise used by a registered Subscriber. Subscribers are only permitted to view and/or browse the contents of the Websites, and/or make only limited copies of portions of this work as fall within the fair use provisions of the Copyright Act, provided all such uses are for noncommercial personal purposes, and further provided that the Subscriber maintains all copyright and any other notices, on all copies. Subscribers are not, however, permitted to store in electronic or any other form, any significant portion of the Websites. The contents of the Websites may not be further reproduced, distributed, transmitted, modified, adapted, performed, displayed (including adaptations/displays such as by “framing”), published or sold in whole or in part, without the prior written permission from OME.

Any use which is commercial and/or non-personal is strictly prohibited, and may subject the Subscriber making such uses to immediate revocation of access to this Paid Subscription Service, as well as any other applicable civil or criminal penalties. Similarly, sharing a Subscriber password with a non-Subscriber or otherwise making this Paid Subscription Service available to third parties is strictly prohibited, and may subject the Subscriber participating in such activities to immediate revocation of access to the Paid Subscription Services; and, the Subscriber and any third party, to any other applicable civil or criminal penalties under copyright or other laws.

In the case of an authorized site license, a Subscriber shall cause any employee, agent or other third party which the Subscriber allows to use the Paid Subscription Service materials to abide by all of the terms and conditions of this Agreement. In all other cases, only the Subscriber is permitted to access the Paid Subscription Service materials.

3. Modification of Terms and Conditions

OME reserves the right at its discretion to change, modify, add or remove the Terms and Conditions for this Paid Subscription Service at any time. Such changes shall be posted on the websites, and all Subscribers shall be notified of such changes. A Subscriber’s continued use of the Paid Subscription Service materials following the posting and such notification of any change to these Terms and Conditions will constitute acceptance by the Subscriber of the Terms and Conditions as modified.

4. Modification of Website or Subscription Service

OME reserves the right to change, modify, suspend or discontinue any or all parts of the websites or the Paid Subscription Services at any time. OME reserves the right to restrict a Subscriber’s access to parts or all of the Subscription Service without notice or liability.

5. Representations and Warranties

The Subscriber represents, warrants, and covenants that nothing uploaded, distributed or published on the websites or the Paid Subscription Service through the Subscriber’s account will be libelous, defamatory, obscene, pornographic, abusive or invade the rights of privacy or other personal or property rights or infringe the copyright or trademark of any person or entity. The Subscriber shall indemnify, defend and hold OME harmless from any damages, expenses and costs (including reasonable attorneys’ fees) arising out of any breach or alleged breach of these Terms and Conditions, representations and/or warranties herein, by the Subscriber or any third party to whom Subscriber shares her/his password or otherwise makes available this Subscription Service. The Subscriber shall cooperate in the defense of any claim brought against OME.

6. Registration

To register, Subscriber must assent to these Terms and Conditions by clicking on the “Submit” button on the registration page, and must provide OME with accurate and complete registration information. Failure to provide accurate and complete information, and failure to timely update the information requested on the registration form may result in delays in establishing Subscriber access to the Subscription Service, OME’s denial of an application or the revocation of Subscriber access to the Subscription Service.

7. Cancellation

You are able to cancel the subscription anytime you would like from your PayPal account. Once the subscription is canceled, the payment shall not be charged. The payment that the subscriber already made through PayPal will not be refunded. The subscription will be renewed and the fee will be charged automatically unless you cancel the subscription from your PayPal account.

8. Security

As part of the registration process, an applicant for a Subscription will be asked to select a password and Subscriber name. Knowing use of the Subscriber name of another or the selection of a name which OME deems offensive may result in termination of access to the Subscription Service.
